Binding Arbitration

The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) in Dallas, TX, and judgment on the arbitration award may be entered in any court having jurisdiction.
Class Action Waiver
To the fullest extent permitted by law, you and Strength & Recovery Solutions agree that all claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST STRENGTH & RECOVERY SOLUTIONS ONLY IN YOUR INDIVIDUAL CAPACITY.
Exceptions
Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies, or seek injunctive or other equitable relief for the alleged unlawful use of intellectual property.
