Informal Resolution
Before initiating any legal action, you agree to attempt to resolve any dispute or claim related to these Terms or the services provided by Strength & Recovery Solutions through good faith negotiations. Binding Arbitration
If a dispute cannot be resolved through informal negotiation within thirty (30) days, both parties agree to resolve any claim, dispute, or controversy arising out of or in connection with these Terms or the services through final and binding arbitration. The arbitration shall be conducted in accordance with the rules of the American Arbitration Association (AAA) in Dallas, TX, and judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver
To the fullest extent permitted by law, you and Strength & Recovery Solutions agree that all claims must be brought in the parties' individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding. YOU AGREE THAT YOU MAY BRING CLAIMS AGAINST STRENGTH & RECOVERY SOLUTIONS ONLY IN YOUR INDIVIDUAL CAPACITY.

Exceptions
Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies, or seek injunctive or other equitable relief for the alleged unlawful use of intellectual property.

 

17. Changes to Terms

We reserve the right to modify or replace these Terms at any time. Changes will be effective immediately upon posting to the Website. It is your responsibility to review these Terms periodically.
